Welcome to Bin Patrol LLC (“Bin Patrol,” “Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our websites (binpatrolwv.com and founders.binpatrolwv.com), our residential trash bin cleaning services, and our text-message program. By using our website, requesting a quote, reserving a Founders spot, or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.
1. About Our Services
Bin Patrol provides residential trash and recycling bin cleaning, sanitizing, and deodorizing services in the Eastern Panhandle of West Virginia. Service details, plan options, and pricing are described on our website and may be updated from time to time. We reserve the right to modify, suspend, or discontinue any service at any time.
2. Service Area & Scheduling
We currently serve Berkeley & Jefferson County, WV, and surrounding areas. Service availability, routes, and scheduling depend on demand, location, and weather. On your scheduled service day, you agree to place your bin(s) at the curb, empty, after your regular trash pickup and to keep them accessible. If a bin is not accessible, is not empty, or is blocked, we may be unable to service it and a visit may still be counted.
3. Founders Program
Our Founders Program offers a limited number of founding-member spots at a locked-in rate. Reserving a spot does not require payment today; you are reserving your spot and rate, and billing begins only once your service actually starts after our launch. Founders pricing applies while your account remains active and in good standing. Founders offers, spot counts, and promotions are subject to change or end at any time.
4. Pricing, Billing & Payment
Prices are listed on our website and may change with notice. Recurring plans (for example, monthly or bi-monthly service) automatically renew and bill on a recurring basis until cancelled. By enrolling in a recurring plan, you authorize us and our payment processor to charge your payment method on file for each service period. Additional bins, add-ons, or one-time services are billed as described at the time of booking. All fees are in U.S. dollars. Failed or declined payments may result in paused or cancelled service.
5. Cancellation & Refunds
There are no long-term contracts. You may cancel before launch at no charge, and you may cancel recurring service at any time; cancellation takes effect at the end of your current billing period. Completed services are generally non-refundable. If you are not satisfied with a cleaning, contact us within 48 hours and we will work to make it right.
6. Discounts, Referrals & Gift Certificates
Discounts (including our veteran, active-duty military, and first-responder discount), referral rewards, gift certificates, and other promotions are subject to eligibility requirements and may be modified or discontinued at any time. Discounts cannot be combined unless we say so in writing, have no cash value, and are non-transferable except as expressly stated. Verification may be required for eligibility-based discounts.
7. Text Messages (SMS) Program Terms
By providing your mobile phone number and opting in, you agree to receive text messages from Bin Patrol WV LLC related to your account and service. This is our messaging program:
- Program description: Bin Patrol sends account and service-related text messages only, such as appointment reminders, service confirmations, route and schedule updates, weather-related service changes, billing and payment notices, and customer-support replies. We do not send promotional or marketing text messages.
- Consent: Providing your mobile number and opting in is your agreement to receive these messages. Consent is not a condition of purchasing any service. You may still use our services without enrolling in text messaging.
- Message frequency: Message frequency varies, up to approximately 4 messages per month, based on your account activity and scheduled service.
- Cost: Message and data rates may apply. Check with your mobile carrier for details on your plan.
- Opt-out: Reply STOP or CANCEL to opt out at any time. After you send STOP or CANCEL, we will send one confirmation message and then stop sending texts. You may receive additional messages if you re-enroll.
- Help: Reply HELP for help, or contact us at 304-659-6555 or BinPatrolWV@gmail.com.
- Carriers: Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.
- Privacy: Your information is handled in accordance with our Privacy Policy. We do not sell your personal information, and mobile opt-in information is not shared with third parties or affiliates for their own marketing purposes.
8. Your Responsibilities
You agree to provide accurate account, contact, and property information; to keep your bins accessible on service days; to notify us of any hazards, pets, or access restrictions at your property; and to use our website and services only for lawful purposes. You are responsible for keeping your payment and contact information current.
9. Right to Refuse or Limit Service
We may decline, pause, or discontinue service for any lawful reason, including unsafe conditions, inaccessible or excessively damaged bins, hazardous materials, non-payment, abusive conduct, or locations outside our service area. Bins containing hazardous, biohazardous, or non-standard waste may not be eligible for cleaning.
10. Disclaimer of Warranties
Our services and website are provided “as is” and “as available.” While we strive to sanitize and deodorize your bins to a high standard, we do not warrant that cleaning will remove all stains, odors, or pre-existing damage, or that our website will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
11. Limitation of Liability
To the fullest extent permitted by law, Bin Patrol LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim relating to our services will not exceed the amount you paid us for the specific service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Bin Patrol LLC from any claims, losses, or expenses arising out of your breach of these Terms, your misuse of our website or services, or your violation of any law or the rights of a third party.
13. Intellectual Property
All content on our website — including our name, logo, mascot, text, graphics, and images — is owned by or licensed to Bin Patrol LLC and is protected by law. You may not copy, reproduce, or use our content without our written permission.
14. Third-Party Services
We use third-party providers to operate our business, including booking and customer-management software (Jobber), website hosting (Railway), analytics, and payment, email, and messaging providers. Your use of those services may also be subject to their own terms and policies.
15. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in West Virginia.
16. Changes to These Terms
We may update these Terms at any time. Changes take effect when posted, and the Effective Date above reflects the latest revision. Your continued use of our website or services after changes are posted means you accept the updated Terms.
